EDPB Supports Global Privacy Efforts on AI-Generated Images
The European Data Protection Board (EDPB) has taken a clear stance on the challenges posed by AI-generated images and videos that depict real individuals without their consent. Chair Anu Talus signed a joint statement on behalf of the EDPB, representing 61 global authorities united in addressing privacy risks related to AI content creation. This effort aligns with the Board’s 2026-2027 work programme, emphasizing the importance of protecting personal data in an evolving technological landscape.
AI technologies have the potential to offer significant benefits, but they also bring serious risks when used to create realistic images and videos of identifiable people without permission. These AI-generated contents can include non-consensual intimate images, defamatory portrayals, and other harmful material. The statement highlights particular concerns about the impact on children and vulnerable groups, who may face cyberbullying or exploitation as a result.
Organisations developing or using AI content generation tools are reminded to comply with all applicable data protection laws and privacy regulations. While legal requirements differ across jurisdictions, there are common principles that must be followed: implementing strong safeguards, ensuring transparency, providing accessible ways for individuals to protect their rights, and paying special attention to risks affecting children.
The signatories emphasize the urgency of regulatory action to address these harms globally. They commit to sharing information and cooperating to tackle the risks effectively. Organisations are encouraged to work closely with regulators, build robust protections into AI systems from the start, and ensure technological progress respects privacy, dignity, and safety, especially for society’s most vulnerable members.
