EDPB demands clear legal basis for cross-regulatory GDPR information sharing
The European Data Protection Board (EDPB) met in Dublin on 16 and 17 July 2026 to address crucial issues about cooperation between regulators in the European Union. The Board emphasized the importance of establishing a clear legal basis for sharing information among different regulators who have overlapping responsibilities under EU law. This legal framework would allow these authorities to exchange relevant information, including confidential data, to enhance enforcement actions within their respective areas.
The EDPB highlighted the increasing challenges faced by Data Protection Authorities (DPAs) due to the rising number and complexity of complaints, particularly driven by the growing use of artificial intelligence. This surge is putting additional pressure on DPAs, which already operate with limited resources. To manage these challenges effectively, the Board discussed the need for both practical and legislative solutions to ensure that GDPR enforcement remains efficient, especially in cases affecting large numbers of people.
To strengthen cooperation, the Board explored ways to pool resources among DPAs, such as enabling complaint-receiving authorities to support lead supervisory authorities. Joint operations and enhanced information sharing were identified as key methods to improve enforcement consistency and effectiveness. The upcoming Procedural Regulation, which formalizes many existing DPA practices, will also benefit from increased exchange of information on national enforcement procedures.
The EDPB recognizes that maintaining consistency in GDPR application requires collaboration beyond its own scope, involving other actors in the data protection ecosystem, including national legislators and courts. The Board reaffirmed its commitment to expanding dialogue with these stakeholders. Additionally, the EDPB reviewed progress made since the 2025 Helsinki Statement, including faster and higher-quality guidance, cross-regulatory cooperation, and better stakeholder engagement, pledging to continue these efforts.
