Ukraine adopts GDPR harmonisation Draft Law
The Ukrainian Parliamentary Commissioner for Human Rights (‘the Commissioner’) issued, on 23 October 2018, a draft law (‘the Draft Law’), which seeks to harmonise Law of 1 June 2010 No. 2997-VI on Personal Data Protection (as amended) (‘the Law’) with the General Data Protection Regulation (Regulation (EU) 2016/679) (‘GDPR’).
The Draft Law outlines the grounds under which processing of personal data will be considered lawful, namely, the execution of a contract to which the data subject is a party, the fulfilment of a duty of the controller under the law, the protection of vital interests of the data subject, as well as the fulfilment of a task founded in public interest and entrusted to the controller by law. In addition, the Draft Law includes provisions on processing personal data based on the data subject’s consent and also on conditions applicable to child consent.
