Meta Brings Legal Action Against EDPB
Meta Platforms Ireland Limited, the parent company of Facebook and Instagram, has lodged two applications (T-128/23 and T-129/23) with the European Court of Justice requesting annulment of the Binding Decisions issued by the European Data Protection Board (EDPB) on 5 December 2022 concerning Irish Supervisory Authority in relation to Meta Platforms Ireland Ltd’s endeavors involving Instagram and Facebook.
Meta claims that the EDPB went beyond its legal capacity as declared in Article 65 of the General Data Protection Regulation (GDPR) and has violated Article 6(1)(b) of this regulation. Additionally, it alleges that the EDPB applied a faulty legal standard based on a mistaken interpretation of Meta Platforms Ireland’s Terms of Use.
Furthermore, Meta avows that the EDPB infringed the right to good administration stipulated in Article 41 of the Charter of Fundamental Rights of the EU through a lack of impartiality when examining matters regarding Meta Platforms Ireland Ltd’s enterprises and services. Finally, Meta alleges that the EDPB violated Article 83 of the GDPR and associated principles coordinating penalties under the GDPR.
