Hungarian DPA issues fine €25,000 for cookie non-compliance
Hungarian data protection authority fined TV2 Média €25,000 for non-compliance in relation of use of cookies on its websites.
TV2 Média Csoport Zrt. operates the “tenyek.hu” and “tv2play.hu” websites, offering media content to the public while displaying ads at the discretion of the data controller. During an assessment of GDPR compliance related to the cookie consent management system (CMS), issues were noted.
Confusion was caused by a second CMS appearing after setting changes in the initial one, and upon being asked for consent it would not accept a ‘no’ answer even though this was clearly stated. Additionally, the informaiton about the cookies – which can be used for individual tracking and profiling – was rendered difficult to access due to a poorly designed user interface.
Despite acknowledging the problems, minor amendments were made that failed to address the heart of the matter. Therefore, the Hungarian data protection authority decision determined that data processing on the Websites must become compliant with the GDPR or else it would be suspended; an administrative fine of 25,000 EUR was also issued as punishment.
