Big changes coming for GDPR enforcement on Big Tech in Europe?
The European Commission (EC) has taken a stand to heighten its oversight of how data protection authorities across the EU’s Member States apply the bloc’s preeminent data privacy regulations – making sure to monitor “large scale” General Data Protection Regulation (GDPR) cases. It comes in response to criticism that law enforcement of the GDPR is excessively feeble and sluggish to keep Big Tech in check.
Thus, the EC has replied to its ombudsman by requiring all data protection supervisory bodies at the national level to share with it on a bi-monthly basis an overview of major cross-border probes under GDPR. Besides, these reports must mention such particulars like case numbers, the controllers or processors engaged, investigation types, description of investigation scope (including which GDPR stipulations are applicable), names of DPAs involved, significant procedural steps and dates, as well as investigatory and any other measures taken, with exact dates being provided.
Further, when putting together its second report on GDPR implementation, the Commission promised to attach details from inquiries it receives from DPAs. In other words, the Commission will be presenting information on DPAs’ reports!
