The European Union Agency for Fundamental Rights (FRA) 2020 fundamental rights report outlines, among other things, the data protection developments in 2019.
Almost all EU Member States had incorporated the General Data Protection Regulation (EU) 2016/679) (‘GDPR’) and the Law Enforcement (Directive (EU) 2016/680) (‘Law Enforcement Directive’) into their national legislation, with the exceptions of Slovenia and Spain respectively. In addition, the Report highlights that there has been a significant increase in the use of new technologies such as artificial intelligence (‘AI’) and facial recognition which impose fundamental rights challenges including privacy and data protection, and that, in relation to data retention, 18 Member States have not yet updated their legal frameworks since the invalidation of the Data Retention Directive (2006/24/EC).
